Public offer to use the site

This document is an official proposal (public offer) of the Web Studio WPSolutionsPRO, registered in accordance with the legislation of Ukraine (hereinafter referred to as the “Contractor”), to conclude an agreement on the terms set out below with any individual or legal entity (hereinafter referred to as the “User”) who accepts this offer by using the website [https://wpsolutionspro.com/] (hereinafter referred to as the “Site”). This Public Offer (hereinafter referred to as the “Offer”) has been developed in accordance with the Civil Code of Ukraine and other regulatory legal acts of Ukraine.

1. General provisions

  • This Offer regulates the procedure for accessing and using the Site by the User, as well as the provision by the Contractor of website development services, consultations and other related services.
  • Using the Site, including filling out forms, sending requests or ordering services, is considered unconditional acceptance of the terms of this Offer.
  • The Contractor reserves the right to make changes to this Offer. Changes shall enter into force from the moment of their publication on the Site.
  • This Offer is a public contract in accordance with Article 633 of the Civil Code of Ukraine.

2. Subject Offers

  • The Contractor undertakes to provide the User with access to the Site and the ability to order website development, web design, technical support, consultations, etc. (hereinafter referred to as the “Services”).
  • The User undertakes to use the Site in accordance with the terms of this Offer and to pay for the Services in the manner provided by the Contractor.

3. Procedure for providing Services

  • To order Services, the User fills out the appropriate form on the Site, providing the necessary information (e.g., contact details, technical specifications).
  • The Contractor confirms acceptance of the order by sending a message to the User’s email or other contact details.
  • The terms of provision of Services, including the scope, terms, cost and payment procedure, are determined in an individual contract, technical specifications or other document agreed upon between the Contractor and the User.
  • The Contractor has the right to refuse to provide the Services if the User violates the terms of the Offer or the legislation of Ukraine.

4. Rights and obligations of the parties

4.1. Obligations of the Contractor:

  • Provide Services with high quality and within the agreed deadlines;
  • Ensure the availability of the Site, except in cases of technical failures or force majeure;
  • Maintain the confidentiality of User data in accordance with the Privacy Policy.

4.2. User’s responsibilities:

  • Provide reliable information to fulfill the order;
  • Pay for the Services on time in accordance with the terms agreed with the Contractor;
  • Do not use the Site to commit illegal acts, including copyright infringement, distribution of malicious software, etc.

4.3. User rights:

  • Receive quality Services in accordance with the terms of the order;
  • Contact the Contractor with questions or complaints regarding the operation of the Site or the Services provided.

5. Cost of Services and payment procedure

  • The cost of the Services is determined by the Contractor and communicated to the User before placing the order.
  • Payment is made in the manner determined by the Contractor, by bank transfer, through payment systems or in another manner agreed upon by the parties.
  • All payments are made in the national currency of Ukraine – hryvnia, unless otherwise provided by the contract.

6. Responsibility of the parties

6.1. The Contractor is not responsible for:

  • Inability to provide Services due to technical problems beyond the Contractor’s control (hosting failures, actions of third parties, etc.);
  • Damages caused by failure to provide or improper provision of the required information by the User.
  • The User is responsible for the accuracy of the data provided and the legality of the use of materials provided to the Contractor for the performance of the Services.
  • In case of violation of the terms of the Offer, the Contractor has the right to suspend or terminate the provision of Services.

7. Force majeure

  • The Parties are exempt from liability for non-fulfillment or improper fulfillment of obligations under this Offer if this is caused by force majeure circumstances (war, natural disasters, actions of government bodies, etc.).
  • The party affected by force majeure must notify the other party within 5 (five) business days.

8. Offer validity and termination

  • The Offer comes into force from the moment of its publication on the Site and is valid until it is withdrawn or replaced by a new version.
  • The Contractor has the right to unilaterally terminate the provision of Services in the event of the User’s violation of the terms of the Offer.

9. Dispute Resolution

  • All disputes arising in connection with this Offer shall be resolved through negotiations between the parties.
  • If the dispute cannot be resolved through negotiations, it shall be subject to consideration in court at the location of the Contractor in accordance with the legislation of Ukraine.

11. Final provisions

  • This Offer is a complete and exclusive statement of the terms of cooperation between the Contractor and the User.
  • All issues not regulated by this Offer are governed by the current legislation of Ukraine.

This Public Offer is valid from September 28, 2025.
